By accessing or using the WinyiSites website, platform, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you may not use our Services.
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and WinyiSites ("we," "our," or "us"). By submitting a website request form, making a payment, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review it carefully.
WinyiSites provides website building and hosting services, including but not limited to:
We reserve the right to modify, update, or discontinue any aspect of our Services at any time, with reasonable notice to active customers where such changes materially affect their service.
To use our Services, you may be required to provide accurate, current, and complete information about yourself and your business. You are responsible for maintaining the confidentiality of any login credentials associated with your account and for all activities that occur under your account.

Our Services are offered on a monthly subscription basis. Current plan options and pricing are published on our Pricing page. By selecting a plan and submitting payment, you agree to the pricing and features associated with that plan.
Payments are due at the beginning of each billing period. We accept Mobile Money (MTN and Airtel), bank transfers, and other payment methods as displayed on our website. All fees are quoted in Uganda Shillings (UGX) unless otherwise stated.
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately, with the price difference prorated for the remainder of the billing period. Downgrades take effect at the start of the next billing cycle.
All subscriptions are month-to-month. There are no long-term commitments, annual contracts, or early termination fees. You may cancel at any time, and cancellation takes effect at the end of your current billing period.
You retain full ownership of all content you provide or upload to your website, including text, images, logos, business information, and any other materials ("Your Content"). By using our Services, you grant us a limited license to use Your Content solely for the purpose of building, hosting, and displaying your website.
The WinyiSites platform, including its templates, design elements, code, tools, and infrastructure, is owned by us and protected by applicable intellectual property laws. Your subscription grants you a non-exclusive, non-transferable right to use our templates and platform for your website.
Our templates are provided as a foundation for your website. While you may customize them extensively, you may not resell, redistribute, or claim ownership of the underlying template designs or code outside of your hosted website.
You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not use our Services:
We reserve the right to suspend or terminate Services for any account that violates these acceptable use provisions, with or without notice, at our sole discretion.
You may cancel your subscription at any time by contacting us. Cancellation takes effect at the end of your current billing period, and you will retain access to your website until that date. No refunds are provided for partial billing periods.
We reserve the right to suspend or terminate your access to our Services if you violate these Terms, fail to make timely payments, or engage in conduct that we reasonably believe is harmful to our platform, other users, or the public. In such cases, we will make reasonable efforts to notify you and provide an opportunity to remedy the situation where appropriate.
Upon termination, your right to use our Services ceases immediately. We may retain your content for a reasonable period to allow for data retrieval or reactivation. After this period, your content and website data will be permanently deleted from our systems.
We strive to maintain high availability of our Services, but we do not guarantee uninterrupted or error-free operation. Temporary disruptions may occur due to maintenance, technical issues, or factors beyond our control. We will make reasonable efforts to minimize downtime and restore service promptly.
Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, WinyiSites shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or our Services shall not exceed the amount you paid us in the twelve months preceding the claim.
You agree to indemnify, defend, and hold harmless WinyiSites, its founder, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from:
We may update these Terms from time to time to reflect changes in our practices, legal requirements, or for other operational reasons. When we make material changes, we will notify active customers via email or through a notice on our website. The "Last Updated" date at the top of this page indicates when these Terms were last revised.
Your continued use of our Services after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription in accordance with Section 7.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Uganda.
